CIBC to pay $149.5 million to Lehman, ending dispute

(Reuters) - Canadian Imperial Bank of Commerce has agreed to pay $149.5 million to the estate of Lehman Brothers Holdings Inc to resolve litigation over a collateralized debt obligation tied to the bankruptcy of the former Wall Street bank.

The settlement announced Monday resolves litigation that began on September 14, 2010, when Lehman sued CIBC and dozens of others to recover more than $3 billion it said it had been deprived of due to its Chapter 11 filing two years earlier.

Lehman sought to hold CIBC responsible for much of the more than $1.3 billion due under an agreement requiring the Canadian bank to cover payment shortfalls tied to a large CDO transaction.

In addition, Lehman contended its contracts gave it senior payment priority, but that the bankruptcy caused it to be improperly replaced with junior payment priority.

CIBC, Canada's fifth largest bank, recognized a gain of $841 million following Lehman's bankruptcy on September 15, 2008, when it had reduced to zero its financial commitment related to a note issued by the CDO.

It has said in regulatory filings that Lehman was the guarantor of a related credit default swap agreement. Monday's payment amounts to $110.3 million after taxes, CIBC said.

Lehman spokeswoman Kimberly Macleod declined to comment.

Once Wall Street's fourth largest investment bank, Lehman emerged from bankruptcy protection on March 6 and has paid out roughly half of the estimated $65 billion it hopes to return to creditors. Its bankruptcy is the largest in U.S. history.

The case is Lehman Brothers Special Financing Inc v. Bank of America NA et al, U.S. Bankruptcy Court, Southern District of New York, No. 10-ap-03547. The main bankruptcy case is In re: Lehman Brothers Holdings Inc in the same court, No. 08-13555.

BANGUI, Dec 30 (Reuters) - Central African Republic's embattled President Francois Bozize said on Sunday he was ready to share power with the leaders of a rebellion that has swept aside government defences to within striking distance of the capital.

The three-week old onslaught by the rebel alliance Seleka has highlighted the instability of the landlocked former French colony, which remains one of the least developed nations on the planet despite its rich deposits of uranium, gold and diamonds.

"I am ready to form a government of national unity with Seleka to run the country together, because I am a democrat," Bozize told a news conference following a meeting with African Union Chairman Thomas Yayi Boni in the capital Bangui.

He added that he was ready to attend peace talks that are being organised by regional leaders in Libreville, Gabon, "without condition and without delay".

It was unclear if the offer would defuse a crisis that has posed the biggest threat to Bozize's nearly 10 years in charge of the country, nestled in the midst of a turbulent region known for wars and haunted by armed groups.

A spokesman for the rebels said the group would consider Bozize's offer, but added its aim was not to join the existing government.

"I take note of his proposals. We need to meet to study them," Seleka spokesman Eric Massi told France 24 television. He said the rebels also wanted to see what guarantees would be made to them.

"Know that Seleka's aim today is not to enter into a government but to allow the people of Central African Republic to be able to drive the country towards development and self-fulfillment," he said.

Seleka, an alliance of three armed groups, accuses Bozize of failing to honour a 2007 deal under which members who laid down their guns were meant to be paid. It claims to have a force of more than 3,000 men and to have positions within 75 kilometers (45 miles) of Bangui.

The last time rebels reached Bangui was in 2003 during the insurgency that swept Bozize to power.

FEARING THE WORST

Residents in the ramshackle riverside capital have either fled or stockpiled food and water in their homes in preparation for a rebel attack.

The streets of the city were largely deserted on Sunday save for military patrols and a trickle of churchgoers. Youths carrying machetes had set up makeshift barricades along main roads during a driving ban imposed overnight.

"There is a great deal of fear here now, and people are hiding their belongings and seeking safety," said Genael Dongonbo, a student at Bangui University from the northern town of Bambari. "I'd also like to leave, but I have no money and the rebels have already seized my town."

With a government that holds little sway outside the capital, some parts of the country have long endured the consequences of conflicts spilling over from troubled neighbours Chad, Sudan and the Democratic Republic of Congo.

Central African Republic is one of a number of countries in the region where U.S. Special Forces are helping local forces try to track down the Lord's Resistance Army, a rebel group which has killed thousands of civilians across four nations.

Regional neighbours agreed on Friday to send more troops to shore up CAR's army after a string of defeats this month, and after French President Francois Hollande rejected a plea for Western military help made by Bozize last week.

The Economic Community of Central African States (ECCAS)already has more than 500 peacekeepers in CAR. Officials did not say how many more would be added or when they would arrive.

About 1,200 French nationals live in CAR, mostly working for mining firms and aid groups in the capital. The French defence ministry sources said Paris had in recent days boosted its force in CAR to nearly 600 from an existing 250-strong deployment safeguarding French citizens.

French nuclear energy group Areva mines the Bakouma uranium deposit in CAR's south - France's biggest commercial interest in its former colony.

The United States said on Thursday it had closed its embassy in Bangui and evacuated its staff.

Dear Annoyed,
That sort of thing really bugs us too. We all have that friend or family member who's so impossible to get a hold of it feels like you're getting the cold shoulder. Assuming your friend isn't actually mad at you for some reason and wants to stay your friend, there may be a few ways to get your messages delivered?and responded to promptly (without feeling like a pest).

Make Sure You Send Your Messages at the Best Time for the Recipient

One possible reason why your friend never hits the reply button is simply the time you usually send your messages. If you friend is in school at night, for example, it's really easy for any late messages to go completely unnoticed?or opened and then forgotten about because she didn't have time to respond at that very moment. My family members tend to call me right at the start of my workday (for a reason I still don't understand), so, similarly, I end up leaving those calls to voicemail even though I would like to talk to them?later.

If you're sending an email, email marketing firm GetResponse analyzed 21 million email messages to find the best hours for sending emails (if you want them opened). Because the majority of emails land in the inbox in the morning, they say those sent in the afternoon have a greater chance of being opened and clicked on. Some Types of Messages May Be Better Than Others

Even those who try to respond to all messages in a timely fashion (e.g., with the 2-2-2 rule) put email as a lower priority than texts, which is beneath phone calls. I'm not sure what the official stance is on IM priority, but I might put that above even phone calls.

If you are sending an email, though, you can boost its chances of being read and replied to if you follow good email etiquette: Keep your email concise (3-5 sentences if possible), be as descriptive as possible in the subject line (a killer subject line helps), remind the person of any previous conversations in case he/she has forgotten them, and make your request as direct and explicit as you can. Short and sweet?yet still complete?works for all other message media as well.

Resend the Message

Maybe your friend just needs a nudge. Whether she forgot about the message or it never actually went through (sometimes spam filters can be overzealous), if the message is important, go ahead and resend it, saying something like "I wasn't sure if you got this, so I'm following up to see what you thought."

Ask for a Reply

Also, if you want a reply, make sure you explicitly ask for it. "Let me know either way" is the one line you definitely should add in your job interview followup letter and it works for other emails as well. Or you could say "What do you think?" or "Please let me know if you're interested or not." Even better: "I need to buy the tickets by noon tomorrow, so if I don't hear from you before then, I'll assume you're not interested."

Get a Mutual Friend to Intervene

Someone else might be able to get your friend's attention better than you could. Don't be offended?perhaps they're just closer or more regularly in contact. If you have a mutual contact, you could say, hey, I'm having a hard time getting in touch with so-and-so, could you forward my message for me?

(As a final resort, if you're really desperate to get in contact with someone, you could spoof caller ID. As mentioned previously, though, you should only use Caller ID spoofing in an emergency case, because once your friend answers and finds out you are masquerading as someone else, it had better be worth it.) Don't Assume the Worst

Finally, your friend probably doesn't know she's annoying you, so try to give her the benefit of the doubt and not be too infuriated by this (admittedly annoying) behavior. You could also talk to her about why your messages aren't being returned. Something as simple as "Hey, did you get my last emails/texts/calls? This seems to happen a lot, and I know you're busy, so what's the best way to get in touch with you and when?" could go a long way towards mending the situation.

Fat influences decisions taken by brain cells for production and survival

Dec. 23, 2012 ? Scientists at Karolinska Institutet in Sweden have identified two molecules that play an important role in the survival and production of nerve cells in the brain, including nerve cells that produce dopamine. The discovery, which is published in the journal Nature Chemical Biology, may be significant in the long term for the treatment of several diseases, such as Parkinson's disease.

The same scientists have previously shown that receptors known as "liver X receptors" or LXR, are necessary for the production of different types of nerve cells, or neurons, in the developing ventral midbrain. One these types, the midbrain dopamine-producing neurons play an important role in a number of diseases, such as Parkinson's disease.

What was not known, however, was which molecules stimulate LXR in the midbrain, such that the production of new nerve cells could be initiated. The scientists have used mass spectrometry and systematic experiments on zebrafish and mice to identify two molecules that bind to LXR and activate it. These two molecules are named cholic acid and 24,25-EC, and are bile acid and a derivate of cholesterol, respectively. The first molecule, cholic acid, influences the production and survival of neurons in what is known as the "red nucleus," which is important for incoming signals from other parts of the brain. The other molecule, 24,25-EC, influences the generation of new dopamine-producing nerve cells, which are important in controlling movement.

One important conclusion of the study is that 24,25-EC can be used to turn stem cells into midbrain dopamine-producing neurons, the cell type that dies in Parkinson's disease. This finding opens the possibility of using cholesterol derivates in future regenerative medicine, since new dopamine-producing cells created in the laboratory could be used for transplantation to patients with Parkinson's disease.

"We are familiar with the idea of cholesterol as a fuel for cells, and we know that it is harmful for humans to consume too much cholesterol," says Ernest Arenas, Professor of Stem Cell Neurobiology at the Department of Medical Biochemistry and Biophysics at Karolinska Institutet, who led the study. "What we have shown now is that cholesterol has several functions, and that it is involved in extremely important decisions for neurons. Derivatives of cholesterol control the production of new neurons in the developing brain. When such a decision has been taken, cholesterol aids in the construction of these new cells, and in their survival. Thus cholesterol is extremely important for the body, and in particular for the development and function of the brain."

The study has been financed by grants from (among other bodies) the Swedish Brain Foundation, the European Union, the Swedish Foundation for Strategic Research, Karolinska Institutet and the Swedish Research Council.

Real Estate Web And Software Stocks: Not Cheap But Are They ...

Real Estate stocks are heating up this winter. The homebuilder ETF (XHB) has increased by nearly 60% this year and dividend rates on REITs have been driven far below 5%, so value investors are now looking for opportunities in adjacent sectors. Timber REITs and agricultural companies with hidden real estate values have already been analyzed in a recent post. Another potential opportunity lies in web and business software companies that support real estate businesses.

Recent public offerings for real estate web companies like HomeAway (AWAY) have fared much better than more headline hogging consumer facing IPO failures like Facebook (FB) and Zynga (ZNGA). The acquisition of the publicly traded Loopnet (LOOP) by CoStar Group (CSGP) for $860 million, a deal that closed earlier this year, also demonstrates that there is significant institutional demand and therefore sustainable value creation in this sector. Since that acquisition in April, CoStar stock has appreciated more than 22%.

An even more spectacular run this year has been the outsized performance of Ellie Mae (ELLI) which has gone from $6 in late January to just about $27 per share this week. This portfolio popper has attracted fans. On October 12, 2012, Brian Schwartz, a Managing Director and Senior Analyst at Oppenheimer & Co. Inc. who covers the SaaS/applications software space, pounded the table for Ellie Mae in an interview with the Wall Street Transcript:

TWST: You have "outperform" ratings on several of your stocks, but which two or three would you point out as best bets for investors at the moment?

Mr. Schwartz: Our top small-cap idea right now is Ellie Mae. We think this business has just a dearth of growth impediments. Right now, they have the recession-resistant ASPs, and we just see lots and lots of greenfield opportunities to grow their business very fast with strong installed, based growth as well as ongoing share gains. And what this means is they have very good visibility into their model and are likely set up to deliver steady ongoing upward revisions to estimates above consensus expectations. We also are a believer in housing recovery, and we think Ellie Mae is really the best software play on housing recovery. So that is one of our top ideas in the small-cap world.

The newly minted IPOs in the web based real estate space are looking to emulate the return multiple that investors got from ELLI this year. The previously mentioned HomeAway is a high growth "rental by owner" business that competes with Silicon Valley darling AirBnB. HomeAway has $300 million in current run rate annual sales, and the company has been rolling up many local and international based web businesses operating in the home rental space. Since its IPO in June of 2011, the Austin, Texas based HomeAway has grown to nearly $2 billion in equity capitalization which must have the venture capitalists in the AirBnB balance sheet licking their thin bloodless lips.

Zilliow (Z) and Trulia (TRLA) are two residential real estate information companies that have recently become publicly traded, Trulia in September of 2012 and its direct competitor Zillow more than a year earlier on July 20, 2011. Both stocks showed an initial surge above their IPO prices but have since come down to earth although Zillow is still above its $20 per share IPO price, while Trulia is right around its $17 per share initial price. As the chart below demonstrates, Zillow roughly doubles Trulia's fully diluted enterprise value. Neither company has been shy about using their new public paper money to make multiple acquisitions. Both are operating around breakeven on a EBITDA basis although Trulia is booking a small net income loss so far this year. Both have roughly similar and massive 75+% revenue growth rates.

Two small cap real estate web companies round out this field, Move.com (MOVE) and ZipRealty (ZIPR). Move.com was a 1999 spin off from Cendant that was sold to Homestore.com but then managed to survive the dot com wash out of 2000 and has grown its business to about $200 million in annual revenues with about $6 million in operating income. The stock is far from cheap at 50 times earnings, especially since top line growth has been missing the last year or so even as the real estate market has revived.

ZipRealty is a interesting potential turnaround story. In a 2009 interview, former CEO Pat Lashinsky highlighted the company's novel lower cost real estate brokerage through web services concept: "First of all, when consumers buy a home with us they get a 20% rebate back of our commission; we do that because we're able to provide for better value than others." Unfortunately, this innovative real estate brokerage and software services website ran afoul of the State of California labor department and was forced to pay $5 million to settle a potential violation of minimum state wage laws. Now that the California labor rights bureaucrats have been pacified the company may have an opportunity for positive developments.

ZIPR has a $75 million equity cap with $20 million in net cash on the balance sheet and about $76 million in run rate revenues, which actually makes it bigger on the top line than Trulia. There is a competitor, private equity darling Redfin, which recently raised $14.8 million in a series "E" round of preferred stock at the end of October in 2011. The multiple rounds of private equity into Redfin, a Seattle, Washington based company, would seem indicate an imminent IPO or attempted exit at an extreme valuation. No one understands this more than the family chef, the person responsible for pulling off a beautiful meal that everyone, with all their peculiarities of preference, will love. And it?s best, of course, if the whole undertaking appears effortless.

Recipe/social cookbook app Foodily can?t finish up your holiday shopping or get that one string of lights to stop blinking already, but it can lend a hand when it comes to putting together a piping hot feast. A powerful search, recipes with user comments and pictures, and lots of advice from celebrity chefs are all on the table with Foodily.

That Time of Year Again

I?m using Foodily to plan my holiday dinner, and this is where everyone finds out I?m a vegan. Before you say that a vegan shouldn?t be reviewing a recipe app, especially before one of the biggest, eatingest holidays of the year, I?m going to have to disagree. There?s plenty of vegan dishes to make anyone, even the most voracious meat eater, happy at the holidays, and if Foodily can?t take care of me, well, it?s not doing a very good job.

Look at all that food. You can find all sorts of things with a little ingenuity.

With that in mind, I did some searches for ?vegan christmas? and ?vegan holiday.? Foodily had nothing for me, but that?s okay, because I can do more searches. I got lucky when I searched for specific vegan dishes, like vegan potatoes (lots of roast potatoes), vegan brussel sprouts or vegan pie.

I was heartened to find I wasn?t just hitting on dishes from a bunch of vegan cooks or blogs, either, but more mainstream chefs. These were just regular dishes that were accidentally vegan but had been appropriately tagged by someone at Foodily based on their ingredients. The same thing went for the other dietary restriction tags, of which I am less familiar but gave a go in the search bar, anyway. If I hadn?t specifically done searches for allergen-free recipes, I wouldn?t have known that?s what I was getting, the recipes looked so very normal and delicious!

Even if you have no dietary restrictions and just want a big plate of turkey, with a side of turkey and turkey pie for dessert (extra peanuts and gluten, please!), you?ll find lots of recipes to fit the bill. You?re just going to have an easier time than me.

Make a List, Check it Twice

So you?re finding all these great recipes for your holiday meal, but what do you do with them? Luckily, Foodily has solved that problem with lists. Whether you want to try out a few new things or plan out a whole meal, you can stick your recipe in a list. I created a list just for my Christmas dinner, and every time I found a recipe I wanted to use on the big day, I?d add it to the list. I can then go back through and review all of my recipes in one place.

You can track all of your favorite recipes, plan meals and create lists of your favorite recipes.

On each recipe page, you can see who has favorited a recipe and their comments. The comments are so helpful, because users can let you know what didn?t go to plan, if they ran into any problems or if the recipe just didn?t work. This is such good information to have before you get started, but would usually only learn after everything has gone to pot. If anyone has uploaded photos, those will be attached to the recipe, too. I?m telling you, look at the photos! If you?re using a celebrity chef recipe, they had a team of staff helping and a professional photographer. You?re just going to have you. It?s nice to know what the reality is before you jump in with both feet.

Below all of that is the nutrition information. Foodily gives you the total calories for the entire dish if you were to eat the whole thing at one sitting, and honey, let me tell you, I?ve done that more times than I care to admit. But people who aren?t me won?t have a lot of use for those numbers. Foodily also breaks it down by calories per gram, but I?m not measuring my food that way, either.

The recipe pages are more than just lists of ingredients. They also show comments from other users and pictures of the completed dish.

If you?re not comfortable using your iPhone as a cookbook, and I can definitely see your logic there, you can email your ingredients lists to yourself, each with a link to the recipe on the Foodily website. You can share your recipes via Facebook and Twitter, even when you?re not actually planning to cook them; instead, just pretend you did. Tip: Use this method to show off to a mother-in-law or other snooty relative that you won?t actually be seeing over the holidays.

Come Back for Seconds

Foodily was well-organized and easy to search, even surprisingly so. If you?re on a special diet, Foodily hasn?t forgotten about you, and it?s easy for just about anyone to find something they?d like to put in their bellies. Not to mention, it?s a really well-designed app. Everything is easy to find, user-friendly and looks good.

While it will definitely be a help to me during the holidays, Foodily has also earned a place on my home screen for the long term. The breadth of chefs, sites and blogs included already encompasses many of my favorites, and the ability to post pictures of the things I cook and comment on others speaks to the latent food blogger in me. It will be an app I return to not just for special occasions, but also when I?m just looking for something new to try.

Injuried parties with protected identity - Romanian Legal Week

The Court of Appeal from Brasov rulled that in the situation when in the indictment are not mentioned the real identification data of the injuried parties, the sanction that occurs is the document relative nullity, this invalidity cannot be removed in any other way than by restoring the document instituting and prosecuting acts.

?Due to article 24 paragraph 1 Criminal Procedure Code the person who suffered through the criminal act a phisical, moral or material damage, if he/she participates at the criminal trial it is named injured party, if he/she exercises a civil action is called hand civil party, due to the second paragraph of the same article, their declarations are considered to be test means? and in this case it is normal that the court proceds of their hearing ( article 326 Criminal Procedural Code ), firstly are taken into account the data concerning their identity, civil and material state, other personal data, and secondly their confessions about the offense and the circumstances in which it took place. As the article 77¹ Criminal Procedural Code states, the hearing of the injured party and the civil party can take place in using special methods likely to those concerning the witnesses, for their protection. So, in the case their life, their coporal integrity and the freedom of the injured party and the civil party are in danger, the prosecutor or the court? can admit the hearing of this party without being present at the place where the judgement is taken, by using the technical machines of the judicial authority, the provisions regarding the protection of the witnessed identification data can be applied using the analogy.

Interpreting these last provisions in the meaning of their application for the injured party or the civil party too equals to an extentions of the criminal law, applying the criminal law for some facts which are not included in their norms, which is an inadmissible situation and it is in contradiction with the principle of legality.

In this case, taking into account the provisions of article 4 from the Law no. 211/2004 concerning some measures to assure the protection of crime victims and also the legal provisions mentioned concerning the protection of witnesses identification data, the criminal prosecuting body, using the analogy extended the criminal law too much and has created a third institution, that of ?? victims with protected indentity ?, unallowed situation and infringed the principle of legality.

So, the victims of a crime have the possibility to choose, either they participate in the criminal trial as injured party or civil party, or they give up this position and they will be heard as a witness.

(?) Proceding in hiding the indentity of the injured and civil parties, the defandents were infringend their right to defend themselves as article 6 paragraph 3 letter b from ECHR states ? every person who is arrested has, especially, the right to be informed in the shortest period of time, in a language he understands and with all the concering details about the nature and the cause of the accusion brought against him, so inclusively he must be informed about the identity of those who accused him when they participate in the criminal trial as injured/civil parties. Using another procedure than by respecting the legal provisions in what concerns the hearing of the injured/civil parties and as a consequence, of the defandents, regarding the way it was done it was an infringement of the contradictoriality principle too, the sanction being relative nullity which can be covered just by having the criminal proceding acts resteored, respecting the infringed legal provisions ?. ( Criminal Decision no. 693 from 22^nd of October 2009 pronounced in appeal? by the Criminal Department and minority cases of Bra?ov Court of Appeal having as object child trafficking- Law no. 678/2001- JURINDEX 2010648471, judges: Aurelia Munteanu, Nicoleta ??n? and Laura Popa ).

Bird beaks show why 'sister' species don't live together

Dec. 14, 2012 ? A study of closely-related bird species has found that they do not coexist in the same region because they remain too ecologically similar and will out-compete each other, not because of geographical barriers or unsuitable habitats.

Oxford University scientists examined 'sister' species -- species that are each other's closest relatives -- of the 'ovenbird' family from South America. They compared data on when these species diverged and where they live today and found that those that have been separated for longest and have evolved very different beaks were able to coexist more rapidly after they became two separate species.

The findings suggest that species displaced due to climate change may not be able to survive in what appears to be a suitable new habitat because a related species already living there will out-compete them for resources.

A report of the research appears this week in Ecology Letters.

'Competitive exclusion between species is generally thought to be limited to relatively small spatial scales, such as between individual birds or across local patches of habitat,' said Dr Alex Pigot of Oxford University's Department of Zoology, lead author of the report. 'In our work we are able to show that competition is a major factor responsible for excluding closely-related species from entire regions. The key was being able to rule out other explanations like geographical barriers, such as rivers, or unsuitable habitats from being the main barriers to 'sister' species co-existing.'

'Ovenbirds' (Furnariidae), so called because in some species their domed nests resemble a traditional Dutch oven, are found throughout South America; there are hundreds of species inhabiting a range of environments from deserts and grasslands to tropical forests. The Oxford team chose to study them because their very diverse beaks give useful information on how related species have evolved to fill particular ecological niches.

'The beak is the main tool used by birds for capturing and consuming food items and so has been moulded by natural selection to fit this purpose,' said Dr Pigot. 'In ovenbirds some species have evolved bizarrely long curved bills in order to prise insects from bamboo stems or beneath the bark of trees, but only one such species tends to live in any given place. Our results suggest that it can take a long time to evolve a foraging niche different enough to allow coexistence amongst related species.'

As environments become hotter or drier, for instance due to climate change, it has been generally assumed that species will track suitable conditions and move to new locations. This new research shows that the area of suitable habitats could be much smaller than current estimates suggest, as many regions will already be occupied by related species that will out-compete any newcomers. This implies that the full impact of environmental change cannot be understood without considering competitive interactions between species.

WASHINGTON (AP) ? Despite an intensifying pace, little progress is being reported in talks on averting automatic spending cuts and tax increases that economists fear could send the U.S. economy off a "fiscal cliff."

House Speaker John Boehner and President Barack Obama spoke on the phone Tuesday, a day after the president offered to reduce his initial demand for $1.6 trillion in higher tax revenue over a decade to $1.4 trillion. But Obama continued to insist that much of the revenue come from raising top tax rates on the wealthy.

Boehner countered later Tuesday with another offer that aides to the Ohio Republican said stuck close to a document delivered to the White House a week ago. A top White House aide, Rob Nabors, came to the Capitol to respond.

Leading lawmakers expressed pessimism that a deal was close, despite increasing angst about a Dec. 31 deadline to stop the expiration of Bush-era tax cuts and separate across-the-board spending cuts that are the result of Washington's failure to complete a deficit-reduction deal last year.

"I think it's getting worse, not better," House GOP Whip Kevin McCarthy, R-Calif., said.

The Boehner camp again said it's up to the White House to proffer additional spending cuts to programs like Medicare. The White House countered that Republicans still need to cave on raising tax rates for the rich.

"Where are the president's spending cuts?" Boehner said on the House floor. "The longer the White House slow-walks this process, the closer our economy gets to the fiscal cliff."

In rebuttal, the White House swiftly detailed numerous proposals Obama has made to cut spending, including recommendations to cull $340 billion from Medicare over a decade and an additional $250 billion from other government benefit programs.

Obama remains determined that tax rates rise on family income exceeding $250,000, a move Republicans say would strike many small businesses that are engines of new jobs and file as individuals when paying their taxes.

Two weeks before the year-end holidays, time to find agreement was short, but not prohibitively so.

"I think it's going to be extremely difficult to get it done before Christmas, but it could be done," Senate Majority Leader Harry Reid, D-Nev., said.

Boehner's office took the step ? unusual in secretive talks ? of announcing that Republicans "sent the White House a counteroffer that would achieve tax and entitlement reform to solve our looming debt crisis and create more American jobs."

Democrats have watched with satisfaction in recent days as Republicans struggle with Obama's demands to raise taxes, but Reid privately has told his rank and file they could soon be feeling the same distress if discussions grow serious on cuts to benefit programs.

In an ABC interview, Obama did not reject a Republican call to raise the age of Medicare eligibility from 65 to 67, a proposal many Democrats strongly oppose.

The proposal is "something that's been floated," Obama said, not mentioning that he had tacitly agreed to it in deficit-reduction talks with Boehner more than a year ago that ended in failure.

"When you look at the evidence, it's not clear that it actually saves a lot of money," Obama said. "But what I've said is, let's look at every avenue, because what is true is we need to strengthen Social Security, we need to strengthen Medicare for future generations, the current path is not sustainable because we've got an aging population and health care costs are shooting up so quickly."

Obama's plan would raise $1.6 trillion in revenue in part by raising tax rates on incomes over $200,000 for individuals and $250,000 for couples. He has recommended $400 billion in spending cuts over a decade.

He also is seeking extension of the Social Security payroll tax cut due to expire Jan. 1, a continuation in long-term unemployment benefits and steps to help hard-pressed homeowners and doctors who treat Medicare patients.

The White House summary noted that Obama last year signed legislation to cut more than $1 trillion from government programs over a decade, and was proposing $600 billion in additional savings from benefit programs.

Boehner's plan, in addition to calling for $800 billion in new revenue, envisions $600 billion in savings over a decade from Medicare, Medicaid and other government health programs, as well as $300 billion from other benefit programs and another $300 billion from other domestic programs.

It would trim annual increases in Social Security payments to beneficiaries and gradually raise the eligibility age for Medicare.
